Terms of Use

These terms apply whenever you use www.bananapoint.ai or any service we offer through it.

They set out who we are, how the service works, how problems are handled and what rights and responsibilities you have as a user, so please read them before you start.

Accessing or using the service is your confirmation that you have read and understood these terms and accept them as binding.

BananaPoint.ai is provided by NerdyTech Hub SRL, a Romanian company (registration number RO40424366) whose registered office is Strada Sondei nr. 1, Câmpina, Prahova, Romania.

Two companies share the running of BananaPoint.ai. NerdyTech Hub SRL (Romania, RO40424366) builds and owns the platform and is in charge of GDPR compliance and the technical integrity of the data. KickOff Ventures LLC (Delaware, USA) handles international sales and customer relations. Your contract is with the company named in the previous paragraph.

BananaPoint does not offer gambling or betting of any kind, but predictions can still influence some audiences. To keep minors away from analytical and probabilistic content, the service is only for people aged 18 or over. Anyone under 18 may not use it.

You may use the service only if the law of the country or region you access it from allows it.

The rules in this section cover everything we post on social media under our official accounts, for example on Facebook, Instagram or X (formerly Twitter).

You accept that our content is analytical and educational only: it is not betting advice and not financial guidance.

Our analysis and predictions show how artificial intelligence can study tennis matches and forecast their results. They are there to inform you and never guarantee any outcome, and all of our content is offered for general information only.

Odds and other figures shown on the website are there for information and analysis only. They have nothing to do with the odds or markets of any bookmaker or betting company.

BananaPoint is no bookmaker or betting operator and never acts as one, and it will never be one of the parties to a bet or gambling transaction.

Subscriptions and other payments on BananaPoint.ai are processed securely by Stripe and PayPal, and when you pay you agree to follow their terms of use.

We never store payment details such as card numbers or bank information; every transaction is handled securely by these authorised providers.

You can cancel your subscription whenever you like, from your account dashboard or by writing to our support team.

Cancelling ends the subscription straight away and no further charges are made. Unused parts of a subscription period are neither refunded nor credited.

Only the very first subscription you buy can be refunded; anyone who has held an active subscription before cannot get a refund on later purchases. To ask for a refund, email support@bananapoint.ai no later than three (3) days after the purchase. We do not process requests that arrive after that.

You may use the service only for your own personal purposes, within the law and never commercially.

In particular, you may not use it:

• in any way that breaks the local, national or international laws or regulations that apply;
• for anything illegal, fraudulent or malicious;
• to harm minors, or try to, in any way;
• to post, share or reuse material that falls short of our content standards;
• to send spam or any advertising or promotional material that is unsolicited or unauthorised;
• to knowingly spread viruses, worms, spyware or other malware, or any code built to damage computer systems or data or to disrupt them.

Without authorisation, you may also not access, tamper with or disrupt:

• the service or any part of it;
• the servers, databases or networks it runs on;
• any software or component that is part of it;
• systems, networks or software of third parties linked to the service, whether those third parties own them or merely use them.

The service and all material published on it are owned by BananaPoint.ai or used under licence. Copyright law and international treaties protect every intellectual property right in them, and all rights are reserved.

You may use the platform for your own non-commercial purposes only. Copying, redistributing or commercially exploiting any part of it requires our written permission in advance.

Anyone who uses the service in breach of these terms has to stop immediately and delete the copies of our material they kept.

Whatever your internet, mobile or data provider charges you for using the website or the service is yours alone to pay; your provider can tell you what those costs are.

From time to time the website may be unavailable while we carry out maintenance, updates or improvements.

We work to keep it running without interruption, but we cannot promise that it will always be available or free of errors. If something is not working, tell our support team.

Our aim is to take reasonable care in providing the service, as these terms describe.

Where we fail to meet these terms, we answer for foreseeable losses or damage that you suffer because of it. We are not, however, liable for:

• loss or damage that results from you breaking these terms;
• delays or failures due to events outside our reasonable control;
• loss or damage that could not reasonably be foreseen when you accepted these terms.

It is up to you to protect and back up your data and to keep the security protection on your devices current. We bear no liability for lost data or damaged devices resulting from use of the service, unless we caused them intentionally or recklessly.

The service is meant for personal use. You undertake not to use it in any business or commercial activity, and we take no responsibility for lost profits, income or business opportunities.
